AI generated passport: what this means for checking working rights

One month ago, Borys Musielak from Poland posted on LinkedIn that he had used ChatGPT-4 to replicate his passport in five minutes.

One month ago, Borys Musielak from Poland posted on LinkedIn that he had used ChatGPT-4 to replicate his passport in five minutes (🌈 Borys Musielak - Juo | LinkedIn). Initially sceptical, I was convinced until a lady from the US posted in the comments, “OMG it works” with a copy of a passport with her own image attached.

Since then, this post has been shared 270 times, sparking discussion from various perspectives. Whether this passport would pass muster or not is not what concerns me most. The movie Catch Me If You Can highlighted in a way only Hollywood can what fraud experts can get away with for a time.

An employer has a legal obligation to verify that all employees have the right to work in Australia. This process often involves manually checking employees’ documentation, such as citizenship or permanent resident status or verifying visa details online through the Department of Immigration’s VEVO (Visa Entitlement Verification Online) system.

Data privacy must be at the forefront of mind when handling sensitive identity data which comes with legal and ethical responsibilities and mandatory requirements under the Privacy Act 1988.(OAIC)

Looking ahead
The Australian Government is exploring digital identity frameworks, such as the Trusted Digital Identity Framework (TDIF), which may soon provide a standardised basis for AI-generated identity verification in employment contexts. If adopted widely, AI-generated passports with embedded Know Your Customer (KYC) checks could become the default method for work rights verification in Australia.

Reporting entity AUSTRAC, recommends steps to KYC in line with Anti-Money Laundering and Counter Terrorism Financing legislation.

For private practice, staying informed and preparing to integrate these technologies will be crucial. Embracing AI-powered verification methods can streamline compliance and enhance trust and efficiency in workforce management

AI-generated identification with integrated KYC checks are poised to redefine how businesses verify work rights in Australia. By enabling secure, accurate and real-time verification, these tools present a compelling solution for private practice to navigate an increasingly complex regulatory landscape. As digital identity and identification becomes more widely accepted the future of work in Australia could be marked by seamless, technology driven compliance across all businesses rather than those large enough to report to the government.
