Workplace

The AMA provides advocacy, policy and campaign services for salaried and private doctors in their dealings with governments, public and private health services and other third parties. This department co-ordinates activity on major professional, legislative and industrial relations developments affecting the medical workforce and produces a range of information on remuneration and industrial relations matters. The AMA has an active program of workplace change initiatives including the Safe Hours Campaign and the Work Life Flexibility Project.

    Coopers and Lybrand were engaged by the AMA to conduct case studies in a number of public hospitals to identify the underlying cultural and organisational systems that contribute to junior doctors' work practices, current rostering practices and hours of work. The case studies were carried out in October and November 1997.

While the Australian health system can benefit from this information, the applicability to Australia of the approaches taken and the provisions introduced in relation to doctors hours of work must be assessed having regard to the very different health systems in which they operate.

    Many doctors are engaged on individual contracts in private medical practice, including part-time and locum arrangements. There are benefits for both the parties to employment or independent contracts in having their respective rights and obligations clearly understood and well documented. This enhances the working relationship and helps to prevent unnecessary disputes. The complexity of the law and issues involved in employment and contracts are such that neither negotiating party may have adequate information to strike a reasonable deal that meets their obligations and protects their interests. Many of the problems that arise could be avoided if parties to medical service contracts were aware of the key issues in drawing up contracts. These guidelines are designed to serve the interests of both parties to medical service contracts. In an environment free of state or federal award regulation it is desirable for individual doctors to seek independent legal or accounting advice on their contracts.

    There is increasing pressure on the public hospital system in Australia and constant debate about the level and allocation of health care resources, leading to changing models of hospital management and medical practice. It follows that there is likely to be pressure on doctors working in public hospitals and other health care institutions to make clinical decisions on economic or other non-medical grounds rather than what is best for the patient. The World Medical Association has recognised this as an international issue, leading to the release in March 1999 of the WMA Statement on Professional Autonomy of the Physician. The AMA maintains that all doctors have an obligation to speak out when they believe that the quality of patient care is compromised.

  54. General Practice Corporatisation: AMA Scoping Paper (November 2000)

    Background Corporatised general practice has been around for up to 20 years but until recently, the marketplace has remained fairly static. During this period corporatisation was characterised by a slowly increasing level of medical centre ownership by corporations, individuals and doctors with and without a clinical practice. During the last 12-18 months a sudden upsurge in general practice corporatisation activity has occurred. This reflects a culmination of an evolution of 20 years of government policy through regulation that has allowed GP rebates to increasingly decline against the cost of living rises and which has seen doctors lose ownership and control of their practices. The key AMA's concerns in relation to corporatisation can be summarised as the: potential loss of capacity of GPs ability to maintain clinical independence; potential for corporate priorities to influence the ethical standards of doctors; potential for corporate interests to influence the volume and direction of referrals; tension between the role of the profession (meeting the needs of patients) and the objectives of the corporation (meeting the needs of shareholders) and the implications for professional control of quality and standards.

    Entrants to the medical workforce have new expectations of medical training, medicine as a career and work/life balance that will significantly impact on the medical workplace. The AMA has conducted research into these expectations and the views of hospitals and training bodies on prevailing work and training practices and the opportunities and impediments to change. This forum offered participants the opportunity to review this research, hear the views of medical training bodies and hospitals and influence options for change.

  56. Towards Training And Workplace Flexibility

    During the past decade a number of detailed research and discussion papers have been released dealing with the Australian medical workforce. Reports on workforce participation and training have been prepared by bodies such as the Australian Medical Workforce Advisory Committee (AMWAC), the Australian Institute of Health and Welfare (AIHW) and the Medical Training Review Panel (MTRP). These studies have identified emerging trends in the composition of the workforce and highlighted the apparent growing divergence between the aspirations and expectations of young doctors entering the workforce and present training and workplace practices. The purpose of this discussion paper is to canvass the more significant issues affecting the medical workforce, their impact on training and workplace flexibility and the scope for driving positive changes that reflect the needs of the new medical workforce.

    The August 2000 meeting of the AMA Federal Council endorsed a strategy set out in a paper titled "Towards Training and Workplace Flexibility" and aimed at progressing an industry and cultural change program for the medical profession to encourage the adoption of greater flexibilities in medical training and workplace arrangements. This paper seeks to map out a draft Action Plan for the first phase of the strategy set out in the paper considered by Federal Council.
